RE: How to Pay CGT on a Property Sold By an Executor For an Estate
Hi,
If there is a Will, the Executors must check the terms to check if there are specific instructions regarding the property. Sometimes a Will specifies that a property, or share of a property, should be held in Trust for the beneficiaries until a certain time, or other such instructions. If so, the Executors must follow the terms of the Will.
But if the Will doesn't make any specific provisions for the property, the Executors should proceed as they see fit. Either the property will need to be transferred into the names of the Beneficiaries (as set out under the terms of the Will) or sold. If the property is sold, the proceeds will then go into the Estate to be distributed to the Beneficiaries.
It is therefore the estate that is selling the property and personal cg losses of the beneficiary cannot be used.

RE: Disposing more than one property in a tax year but on different disposal dates

When you report the 2nd disposal, it asks you to give a total for the year to date to take into account any disposals already declared.

No as the period you lived in it is no longer applicable as you are taking the purchase date as 06/04/15 by using rebasing. By taking this date you have never lived in the property.

As no income for the last 2 years you dont need to do anything. As you will now be letting out your UK house, you will need to declare this in a tax return as this remains liable here and not
exempt so the DTA form is not applicable.

No, these fees are solely in relation to the selling of the property and will be reflected in the capital gain/loss that can then be used against future gains only.
