RE:Aviva Annuity & 1257L Tax Code for Non-Resident?
Hi ThaiGordo,
Please go to:
www.gov.uk and search for 'DT individual'.
Some countries have a version dedicated to them, so look through the versions to find the appropriate version.
Download and print of the form.
Complete it to include all of your UK private pensions / annuities and state pensions, sign and date it and then post it to your local tax office in your country of residence.
The tax authorities there, will validate the form and return it to you.
Please then send the validated for to HMRC at the address on the front page of the form.
Please note that repayments can only be made into a UK bank account.

RE: P85 for past years
Hi Neadtwailn Ncaazr,
If he did not declare that he was renting out his home while overseas on his P85, he will need to register for Self Assessment, as he will be a non resident landlord.

As he is a UK national, he is entitled to claim for personal allowance, no matter where in the world he lives (this is done on SA109).
As a non resident, he cannot complete the online HMRC taxc return.
He will need to either submit a paper SA100, SA105 and SA109, which can be obtained from the Self Assessment orderline here:

No, you will be able to amend your tax return to include the Foreign Tax Credit.
You can either log in to your online tax return and amend it from there, or write to:

There are no UK tax implications on this payment and should not be declred in your Self Assessment tax return.

RE:Reclaiming tax withheld by HMRC on UK personal pension plan lump sum, for tax resident of Malta
Hi Leamcon,
As you are not resident in the UK, the tax deducted by your pension provider from your lump sum can be repaid to you.
You will need to download and print of the DT individual form here:
Double Taxation: Treaty Relief (Form DT-Individual)
You should declare all your UK pensions, including UK state pension on the form and send the signed and dated form to the Maltese tax authorities. The Office for commisioner for Revenue, will note your sources of UK income and validate the form, to confirm you re resident in Malta and taxable on those pensions there.
They will return the validated form to you, so that you can send it to HMRC at the address on page 1 of the form.
When processed by HMRC, any tax deducted in the current tax year will be repaid by your pension provider and any overpaid tax from an earlier tax year, by cheque (only to UK banks).
