Yes, you need to complete the SA109 to show that you are non domiciled and then claiming the remittance basis and this needs to be sent with a full tax return.

P85 Nil Tax Code Query

The tax treaty between the UK and Thailand
UK-Thailand Double Taxation Convention signed 18 February 1981
Does not include an article on pensions or other income.
This means that there is no double taxation relief for pensions, lumps sums, trivial commutations or state pension.
A resident of Thailand, with a UK pension, lumps sums, trivial commutations or state pension, remains taxable on them in the UK.
This means that a P85 is only required to notify HMRC that you have left the UK.

You can retain ownership of the property whilst transferring the beneficial interest to your spouse.
They will become entitled to their share of the rental income and will need to declare this to us. HMRC to not require sight of the declaration made but you should retain this if required in future.

RE: Pension incorrectly paid as Salary Sacrifice
Hi NeilRedfern,
If they were taken as a salary sacrafice then the payments would be taken from your pay before tax is calculated.
In this case you would not be able to claim further tax relief on your Self Assessment.
