  • RE: VAT on work to existing energy saving equipment

    Hi Tom Llanwarne,

    The main supply here appears to be repair and maintenance rather than a new installation of energy saving materials.
    Without a breakdown of the scope and cost of the additional equipment we cannot give a definitive answer on whether the supply qualifies for zero rating.

    Hi CJ123,

    The only way we can consider whether you would be entitled to continue to pay UK National Insurance contributions, is if you complete the application forms CA3821 and CA3822.  
    In some circumstances we can consider the application where the employee isn’t posted, but has agreement with their employer that they can work in another EU country temporarily.

    Hi Kerma,

    Unfortunately, without looking at your personal records, I am unable to provide you with a definite answer. 
    However, I can confirm that the National Insurance contributions that you are paying in the EU cannot be credited to your UK records for pension or benefit purposes.
    With regards to your self-employment in the UK, you would need to provide HMRC with further information for us to confirm if you should be paying class 2 National Insurance contributions in the UK. You can write to us at the following address –

    Please include the following details in your letter
    •    Your full name
    •    Your National Insurance number 
    •    Your date of birth
    •    Your most recent UK address
    •    Your address abroad
    •    The type of work you do

    •    Where the contract is held
    •    How often you work in the UK
    •    Your normal working pattern (the days, weeks or months you regularly work)

    If you are in receipt of your UK state pension and have seen an increase in the amount paid to you please contact the Pensions Service part of the Department for Works and Pensions their contact number is 0800 731 0469.
    If you are not in receipt of your UK state pension please contact the Future Pension Centre on 0800 731 0175 for more information Contact the Future Pension Centre 
    Our banking teams are currently dealing with payments received on 12 June 2023, if you made your payment before this date and you have had confirmation that paying Voluntary NICs will increase your state pension entitlement please contact our NI helpline on 0300 200 3500.

    If you are over UK state pension age (SPA) then you will not be liable for National Insurance contributions.
    If you are in receipt of your employed company pension and are under the UK SPA then you should be paying voluntary NICs for any years in which you are deficient.

    Hi Rob Rosewarne,

    Yes an Option To Tax is completely voluntary.
    If you choose not to Opt To Tax then it just means that you will not charge VAT on your rent and you won't be able to reclaim the VAT on the rent charge you incur from the landlord.
    You can still register for VAT on the basis of selling goods.
    It would mean that you would charge VAT in relation to the goods you sell but you would not charge VAT to your tenant for the rent as there would be no Option To Tax made on the property by yourself.

    Hi Kenneth Marwood,

    You can claim any expenses that are incurred 'wholly and exclusively' in carrying out your business.
    Please see BIM37007 BIM37007 - Wholly and exclusively: overview.
    However you must clearly differentiate between business and personal and keep clear records.
    I have attached PIM2100 which states what you can claim.
    However it must be apportioned clearly, for example if you have four rooms in your house you can claim a quarter of all running costs so long as they are related to your business.
