RE: Transferring Rental Income to Wife (Deed of Assignment)
Hi MarkSteed,
You should submit a form 17 with a valid declaration of trust stating the percentage split.
This should be signed by both yourself and your wife. See TSEM 9230 TSEM9230 - Ownership and income tax: legal background: joint ownership - presumption of joint tenancy.
Relief on interest from a mortgage can only be made by the person who takes out the loan, pays the interest on the loan and applies from the loan in a form that meets the qualifying conditions.
This is explained in the savings and investments manual SAIM10030 SAIM10030 - Relief for interest paid: general conditions: the claimant.
There is no capital gain when a property is transferred between husband and wife.
This is at a no gain/no loss stance. See CG22070. CG22070 - Transfer of assets between spouses: definitions.

You can submit a declaration of trust stating the percentage split of beneficial ownership for HMRC purposes.
The beneficial owner who 'enjoys' the income would be chargeable to the income tax.

Trader can contact NDRC on customsaccountingrepayments@hmrc.gov.uk by stating they are progress chasing a C285 claim and enter "NDRC" in subject of the email.

Hi George Lunt,
If someone is bringing personal belongings back to UK and not moving permanent resident and these items were purchased in UK and taxes were paid then they can look inito returned goods relief. Please refer to below link for more guidance.
If a person bringing these items in personal car, please refer to Goods imported in baggage section.

RE: Salary payment to my mother
Hi Robert Beliaiev,
From a PAYE point of view you can pay employees what you wish regardless of the work done.
I'm not sure if other departments such as Corporation Tax etc would have issue with this as it could be used as an avenue for fraud.
You may have to contact these other departments to check if you are required to do anything further.

RE: Overpayment
Hi s_j_R,
We wouldnt be able to advise on this.
You would need to speak to UC and explain the situation to them.
The employer must report what you were actually paid, if you then pay this back then you would speak to personal tax on 0300 200 3300 re overpaid tax etc.
However I'm not sure if they would be able to amend the income reported.
