Hello, I'm resident abroad (Spain), self-employed and am filing my taxes through commercial software. I know I need to fill in SA109, but do I also need to fill in SA103 or SA106? Thanks in advance!

Hello HMRC advisers, I've read through the notes a few more times and I'm still very confused about this. I'd really appreciate guidance. Thanks!

Hi,

As tax resident in Spain, you should be declaring your taxes there.

You should check to see if a tax return is required:

Check if you need to send a Self Assessment tax return

Thank you.

Obviously I file my taxes in Spain. However, I am required to file my taxes in the UK too, and this comment by HMRC Admin 19 hasn't even tried to answer my query. In fact, the tool in the link above doesn't even ask about living and working abroad; HMRC Admin 19 should have sent me this link instead: https://www.gov.uk/tax-right-retire-abroad-return-to-uk (specifically, the section under How to Tell HMRC — If you usually complete a Self Assessment tax return). Since I am required to fill in SA109 (as it explains in the above link), I am required to fill in my self-assessment form. The only thing is that I don't know if I also need to fill in other parts of it, such as SA103 or SA106. Could someone from HMRC please confirm?

Hi,

We do not know the reason why you need to complete a Self Assessment tax return. If you are not resident in the UK for the whole tax year, you may not have any income that is taxable in the UK, so you will need to consider whether a tax return is still required. There is a Self Assessment check tool which will help you determine if a tax return is still needed here:

Check if you need to send a Self Assessment tax return

If you require specific information relating to your individual situation you will need to contact our Self Assessment team.

Thank you.
