My mother-in-law died last September & my wife is executor. We have received a request from HMRC to file a paper SA return for the period from 06/04/2022 to the date of death. The paper return notice asks for the return to be filed by 06 March 2023. This seems unreasonable as we do not yet have probate (which complicates getting information) & banks etc only issue tax certificates after the tax year ends. It may be wrong as supplementary pages for 2022-23 are not yet available & a 'normal' SA paper return for the 2022-23 tax year would not be due until 31/10/2023. Is this a mistake by HMRC or do we need to file a return with a multitude of provisional figures?

Thanks for replying. unfortunately your SA helpline is inundated and I was unable to get through. elsewhere in these forums one of your colleagues posted that it is not possibly to take a return for 2022-23 until after the year end. That suggests to me that the date of 06 March was a mistake by your colleague. Can you refer to a technical colleague who could answer the post. It will make work for both of us if we have to submit an incomplete return.

Hi Rob Kingston,

Our 21/22 tax return deadline is set at 31 January 2023.
Returns received after that date may incur a late filing penalty.
Where we have to issue a tax return, that is not a late request, we extend the filing date, to give a reasonable amount of time to complete the tax return.
In the case of the request you have received, you are being given extra time, up to 6 March 2023, to file the return and avoid late filing penalties.

Thank you.

HMRC admin 20 - please read the post carefully. the return requested is for 06 April to the death in September 2022. Is that a return for 2021-22 or 2022-23? I would have thought the latter - hence the post.

Hi,

That falls into the 2022 to 2023 tax year.

Thank you.

Thank you. progress. However you still have not replied to the original post. The HMRC notice is requesting the return for the period 6 April 2022 to the date of death in September 2022. It asks for this return to be made by 06 March 2023. Can you confirm this is an error and it should it be filed by 31/10/2023?

Hi Rob Kingston,

For an in year return the deadline will be 3 months and 7 days from the date of request.

Thank you.

I was aware of this time limit where the return is issued alter than normal; are you sure it applies when the return is issued earlier than normal, as in this case; it seems strange to say the least? I do not see it in SALF203?

Hello Rob,

This will need to be reviewed by the department who process the returns as we are unable to access the record from this forum.

Thank you.

How can I contact the relevant department as the only phone number is the helpline which is busy?
